Should you qualify for this data breach class action settlement, up to $5,300 could be in your pocket soon. Citizens who received letters regarding the data breach from the Retina Group of Washington are deemed eligible for compensation of up to $5,300 as per the $3,6 million class action settlement. Due to a data breach that took place in March 2023, sensitive information such as Social Security numbers, health insurance details, and driver’s license numbers was exposed. A cash reimbursement compensation for identity theft and credit monitoring is also available.

Understanding the data breach in March 2023

A cyberattack that took place on March 26, 2023, saw the medical as well as personal data of patients of the Retina Group of Washington (RGW) being exposed. It is believed that information about 450,000 patients was exposed. RGW is considered to be a well-known eye care provider situated in both Virginia and Maryland.

Due to the cyberattack and the patients’ data that had been exposed, victims filed a class action lawsuit, which alleged that the eye care provider did not implement the necessary security measures to prevent the breach in the first place. While RGW denied all allegations of wrongdoing, they were in favor of the $3,6 million settlement to resolve all allegations.

Ever since the data breach, RGW has taken necessary measures to tighten security and has undergone cybersecurity training and implemented stronger password policies.

Who qualifies to claim up to $5,300?

All patients who received a letter documenting the details of the breach from the RGW qualify as class action members. While those who experienced any fraud-related issues or monetary loss can claim more, other patients who did not incur monetary loss are also eligible to claim.

As per the settlement agreement, claimants can receive:

Cash payments of up to $5,300

Patients who suffered financial loss due to the breach can receive:

  • $300 for expenses such as bank fees, phone or data charges, and credit monitoring costs. These claimants can also claim up to four hours of lost time, paid out at $25 per hour.
  • For extraordinary losses such as fraud or identity theft, citizens can receive about $5,000; however, such serious claims must be supported by documentation indicating the extent of these severe losses.

Cash payments of $100

A cash payment of about $100 is also on offer to patients who could not indicate specific losses on their claim forms. This cash payment amount may not be exactly $100 and depends on how many claimants file a claim before the claim filing deadline. Those who claim this cash payment will not be eligible for free identity theft protection services or free credit monitoring offerings.

Credit monitoring

Some eligible claimants can choose to forfeit any cash payouts to receive the perk of free identity protection services, which would include:

  • Credit monitoring from all three major bureaus every day
  • $1 million in identity theft insurance
  • Services for identity restoration

The deadline to claim for this class action settlement is fast approaching; however, about a month remains to claim for the Imagine360, LLC, data breach settlement.

Deadline for filing for this class action settlement

All patients who qualify for this data breach settlement can be eligible for one of the payout options or the identity protection services on offer if they claim by June 23, 2025. The deadline for objections and exclusions has already passed and was on May 27, 2025.

The final approval hearing took place two days ago, on June 9, 2025, even before the filing deadline.

What is required when filing a claim?

Eligible patients who wish to file a claim will have to provide a unique Claim ID and the PIN that was indicated on the settlement notice. Those citizens claiming up to $5,300 must include all documentation or proof of the losses caused by fraudulent activities. The deadline is fast approaching, so all claimants should submit a valid claim before that date.
